ARRIVAL GO MOBILE APP – TERMS OF SERVICE

Welcome & Overview

Welcome to the Arrival Go mobile app! Before you start using the app, it’s important that you read and agree to the following terms. These terms help protect both you and us and provide clarity on what you can expect from using our services.

1. Terms of Service (ToS) and Disclaimer

1.1 Introduction

The Arrival Go app provides location-based services—and may also share battery level and activity-related information—to help you and your friends or family coordinate and connect more easily. By using our app, you agree to these Terms of Service.

1.2 Eligibility

Age Requirement: You may use the app only if you can form a binding contract and meet the minimum age requirements in your jurisdiction. If you are under 13 (or under the age of 16 in certain jurisdictions where parental consent is required), you may not create an account or use the service unless a parent or legal guardian has provided explicit consent and assumed responsibility for your use.
Compliance: You agree to use the app in compliance with all applicable laws, rules, and regulations, as well as these Terms of Service.

1.3 User Responsibilities

Lawful Use: You are responsible for using the app in a lawful manner.
Prohibited Activities: You must not use the app for any activities that violate local laws or infringe on the rights of others.

1.4 Prohibited Uses

You agree not to:

Copy, modify, or create derivative works from any part of the Services, including attempting to reverse-engineer or extract source code.
Upload or transmit viruses, malware, or other harmful code.
Use any automated system (e.g., “robots,” “spiders”) that sends more requests to our servers than a human can reasonably produce.
Impersonate another person, misrepresent your affiliation, or conceal your identity.
Interfere with the operation of the Services, circumvent access restrictions, or compromise system integrity or security.
Collect or harvest personal information from other users without their consent.
Engage in harassment, threats, hate speech, or other content that we deem unlawful, abusive, or otherwise objectionable.
Use the Services for commercial or unauthorized purposes.
Export Restrictions: You may not use or otherwise export or re-export the Arrival Go app except as authorized by United States law and the laws of the jurisdiction in which the application was obtained. This includes, without limitation, any use or export to U.S.-embargoed countries or to individuals on any U.S. government restricted lists. By using the app, you represent and warrant that you are not located in any such restricted country or on any such list.

1.5 Content Sharing

Authorized Content: Users can share locations, images, and other forms of content. You must ensure you have the right to share any content you upload or transmit.
No Infringement: Shared content must not violate any third-party rights or applicable laws.

1.6 Location & Activity Sharing

Consent to Share: By enabling location sharing—whether by toggling the switch or accepting a location-sharing invite—you agree to share your real-time location and any associated activity data (e.g., whether you’re walking, running, cycling, or in a vehicle) and, if enabled, your device’s battery level with the friends and/or family groups defined in the app for the duration indicated or until you manually disable these features.
Private & Family Groups: Once you accept an invite to a private or family group, your location, battery level, and activity type sharing will remain active unless or until you leave the group, disable sharing, or otherwise revoke permissions.
User Responsibility: You are solely responsible for any consequences arising from sharing your location, battery level, or activity data. This includes ensuring you understand which groups have access to your information and manually disabling sharing if desired.
Disclaimer of Liability: Arrival Go is not responsible for how other group members use, store, or share your location, battery level, or activity data once it has been disclosed. You acknowledge that you share such information at your own risk.

1.7 SMS Verification Terms & Conditions (One-Time OTP)

Opt-In & Purpose By entering your mobile number in the Arrival Go app and start the sign-up / sign-in process you explicitly request and consent to receive one (1) SMS text message containing a one-time password (OTP) for account verification.
Message Frequency
- One message per verification request.
- No recurring or promotional texts will be sent unless you initiate another OTP request.
Message & Data Rates Message and data rates may apply to the OTP we send you. Contact your wireless provider for details about your text or data plan.
Supported Carriers Arrival Go can deliver OTP messages through the following carriers:
- Major carriers – AT&T, Verizon Wireless, T-Mobile, Sprint, MetroPCS, US Cellular, Alltel, Boost Mobile, Nextel, Virgin Mobile, Bell, Rogers, Telus, Freedom Mobile, Fido, Koodo, Virgin Plus, SaskTel, Eastlink
- Minor carriers – Alaska Communications Systems (ACS), Appalachian Wireless, Bluegrass Cellular, Cellular One (various regions), Cincinnati Bell, Cricket, Coral Wireless (Mobi PCS), Cox, Cross, Element Mobile, Epic Touch, GCI, Golden State, Hawkeye, Illinois Valley, Inland, iWireless, Keystone Wireless, Mosaic, Nex-Tech, NTELOS, Panhandle, Pioneer, Plateau, Revol, RINA, Simmetry, Thumb Cellular, Union, United, Viaero, West Central, Cityfone, Public Mobile, Lucky Mobile, PC Mobile, Videotron, Tbaytel, Xplore Mobile, Ice Wireless, NorthernTel
- Carriers are not liable for delayed or undelivered messages.

1.8 Accounts

Accurate Information: When creating an account, you must provide accurate and complete information.
Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Notification of Breach: You must immediately notify us of any unauthorized use of your account or any other breach of security.

1.9 Service Availability and Modification

Changes or Discontinuation: We may modify, suspend, or discontinue the Services (or any part thereof) at any time for performance, security, legal, or other business reasons.
Termination: We reserve the right to suspend or terminate your account if you misuse the app or violate these terms. We will make reasonable efforts to notify you before taking such action unless immediate suspension is required to prevent harm or comply with legal obligations.

1.10 No Professional Advice

Any information provided by Arrival Go—whether through location features, notifications, or any other functionality—is for general informational purposes only. We do not provide medical, legal, or other professional advice. You should seek independent professional advice from a qualified individual if you have questions of a professional nature.

1.11 User Content

Ownership: You retain all rights to the content you create or post within the app (“User Content”). We do not claim ownership of your User Content.
License: By uploading User Content, you grant Arrival Go a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content for the purpose of operating and improving the Services.
Removal of Content: We reserve the right, but are not obligated, to remove or disable access to any User Content that violates these Terms or applicable law.

1.12 Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Arrival Go, its subsidiaries, affiliates, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt—and expenses (including attorneys’ fees)—arising from:

Your use of and access to the Services.
Your violation of any term of these Terms of Service.
Your violation of any third-party right, including but not limited to any intellectual property, confidentiality, or privacy right.
Any claim that your User Content caused damage to a third party.

1.13 Disclaimer of Warranties

As-Is Service: The Services (including any software or mobile applications) are provided “as is” and “as available.”
No Warranties: To the fullest extent permitted by law, Arrival Go disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Accuracy of Location & Activity Data: We make no guarantee that location data, activity type data, battery level information, or other service outputs will be timely, accurate, or error-free. You acknowledge that such information may not always reflect real-time conditions or movements.

1.14 Additional Software Disclaimer

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

1.15 Limitation of Liability

No Liability for Indirect Damages: To the maximum extent permitted by law, Arrival Go and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of data, or other intangible losses.
Cap on Liability: To the extent not prohibited by law, in no event shall Arrival Go’s total liability to you for all damages exceed fifty dollars ($50.00), regardless of the theory of liability (contract, tort, or otherwise).
Exclusions: Nothing in this Agreement excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

1.16 Dispute Resolution & Arbitration

Informal Resolution: We encourage you to first contact us at legal@arrivalgo.com to resolve any dispute informally.
Agreement to Arbitrate: To the extent permitted by law, you and Arrival Go agree to resolve any claim or dispute arising out of or relating to these Terms or the Services through final and binding arbitration, rather than through court proceedings, on an individual basis.
No Class Actions: You and Arrival Go each waive the right to participate in a class action or class-wide arbitration.
Exceptions: Either party may seek injunctive relief in court for matters relating to intellectual property infringement or unauthorized access to the Services.
Governing Law and Jurisdiction: This Agreement and any disputes arising out of or relating to this Agreement shall be governed by the laws of the State of California, excluding its conflict of law provisions, unless otherwise required by applicable law. You agree to submit to the personal and exclusive jurisdiction of the courts located in Santa Clara County, California.

1.17 Third-Party Links and Services

The Services may contain links to third-party websites or resources. We do not endorse and are not responsible for the availability, accuracy, or content of such external sites or resources. Your interactions with third-party sites are solely between you and the third party.
Third-Party Services Disclaimer: The Services may enable access to third-party content, data, or services. Arrival Go is not responsible for the availability, accuracy, or legality of any third-party content or services accessed through the app. You acknowledge that you use such third-party services at your sole risk and that Arrival Go shall not be liable for any damages or losses arising from or related to your use of third-party services.

1.18 Beta Services

From time to time, Arrival Go may offer features or functionalities labeled as “beta” or “early access.” These Beta Services are provided on an “as-is” basis, may be discontinued at any time, and may contain bugs or errors. We do not guarantee the reliability or performance of any Beta Services.
Beta Services Disclaimer: Beta Services may be provided on an “as-is” basis without warranties of any kind, express or implied. Arrival Go disclaims any liability for errors, data loss, or interruptions related to the use of Beta Services. By participating in any Beta Services, you acknowledge and accept that the services may contain bugs or other defects and that the use of such services is at your own risk.

1.19 Updates and Modifications

We may update these Terms of Service from time to time to reflect changes in our practices, technology, legal requirements, or other factors. It is your responsibility to review these Terms periodically. Your continued use of the Services after any changes indicates your acceptance of the updated Terms.

3. End User License Agreement (EULA)

3.1 License Grant

Arrival Go grants you a limited, non-transferable, and non-exclusive license to use the app for personal purposes only.

3.2 Restrictions

You may not decompile, reverse-engineer, or otherwise tamper with the app.
Accessing or attempting to access any data for which you do not have permission is strictly prohibited.
Export Compliance: You may not use or otherwise export or re-export the app except as authorized by United States law and the laws of the jurisdiction in which the app was obtained. By using the app, you represent that you are not located in any restricted country or on any U.S. government restricted list.

3.3 Intellectual Property

All content, features, and intellectual property rights related to the app belong to Arrival Go.
You may not copy or use any part of the app for commercial purposes without prior written consent.

3.4 Termination of License

This license is effective until terminated. We reserve the right to terminate your access at any time for breach of these terms. Upon termination, you must immediately cease using the app and delete all copies of the app from your devices.

4. Acceptance of Terms

By downloading, clicking the checkbox or logging on to use the Arrival Go app, you acknowledge that you have read, understood, and agree to these Terms of Service (including the Additional Software Disclaimer), Privacy Policy, and End User License Agreement. If you do not agree to these terms, please do not use the Arrival Go app.
